Therabody Limited Warranty for the United States

This Therabody Limited Warranty (“Warranty”) sets forth the rights and responsibilities between Therabody, Inc. and its subsidiaries (collectively, “Therabody”) and the end-user purchaser (“You” or “Customer”) concerning the product(s) you have purchased directly from us and our authorized resellers in the United States.

Because Therabody cannot control the quality of products sold by unauthorized sellers, this Warranty applies only to products that were purchased from Therabody or a Therabody authorized seller in the United States, unless otherwise prohibited by law. Therabody reserves the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized Internet sites.

We encourage you to review this Warranty thoroughly to understand the terms and conditions under which your product is covered. Should you have any questions or require assistance, our Customer Service team can provide support and guidance. Please note that by using a Therabody product you are agreeing to be bound by the terms of this Warranty. All Warranty services must be authorized and performed by Therabody or a service provider expressly authorized by Therabody.

Warranty Period

Therabody warrants its products and accessories against defects in materials and workmanship when used normally in accordance with Therabody’s published guidelines for the periods set forth below (“Warranty Period”). The Warranty Period begins on the date of delivery to the original end-user purchaser. Therabody’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. Certified Refurbished products purchased from Therabody will be further subject to the warranty terms set forth in the Certified Refurbished Product section below.

Limited Warranty Periods

  • Devices: 1-Year Warranty
  • Attachments and Accessories: 90-Day Warranty*

*Please note that accessories exclusively include charging cables, removable components of the devices, adapters, carrying cases, and charging stands.

Warranty Exclusions

This Warranty does not cover: (i) products purchased from unauthorized resellers or distributors; (ii) products that have been subjected to abuse, misuse, negligence, accident, alteration or accidental damage, including, but not limited to, contact with liquid; (iii) products that have been used for purposes other than those for which they were designed or intended; (iv) cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (v) defects caused by normal wear and tear or otherwise due to the normal aging of the product, including, but not limited to noise; (vi) any damage resulting from failure to follow product instructions, improper installation, or failure to perform routine maintenance; (vii) products sold “AS IS” or similar notions; (viii) consumable parts such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (ix) damage due to unauthorized repairs or modifications; or (x) products with any serial number removed or defaced. Any software is provided “AS IS” unless expressly provided for in any enclosed software limited warranty. When a product or part is exchanged, the original item becomes Therabody’s property.

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. THERABODY LIMITS THE DURATION OF ANY IMPLIED WARRANTIES THAT MAY BE APPLICABLE TO PRODUCTS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

This Warranty does not apply to any non-Therabody branded products. Therabody does not warrant that the operation of its products will be uninterrupted or error-free. Therabody is not responsible for damage arising from failure to follow instructions relating to the product’s use.

Warranty Claims

Therabody will replace any product that proves to be defective during the Warranty Period with a product of the same model that is new or comprised of new and/or previously used Therabody parts that have been tested and passed Therabody’s functional requirements and are equivalent to new in performance and reliability. Any replacement product provided under this Warranty may vary in the color and/or cosmetic design from the original product and may not include any original engraving or similar customization. Discontinued products may be replaced with a product of comparable value and function.

To obtain warranty service, you must contact Therabody’s Customer Service team through the Contact Us page here and follow the provided instructions for warranty claims. If a product is replaced under warranty, the original Warranty Period will continue from the date of delivery of the original product, not from the date of replacement.

Before receiving warranty service, Therabody may require that purchaser furnish proof of purchase details and/or respond to questions designed to assist with evaluating potential issues. If Therabody determines that the problem with the product is not due to a manufacturing defect related to materials and/or workmanship or the product is not properly returned to Therabody, or otherwise does not qualify for warranty replacement, then the purchaser will be responsible for all costs incurred by Therabody necessary to return the product. Unless otherwise instructed by Therabody, the product must be delivered, freight prepaid, in either its original packaging or packaging affording an equal degree of protection to the location specified by Therabody’s Customer Service team. Please note all warranty returns must include the completed Return Authorization Form.

Limitation of Remedies

Therabody does not authorize anyone, including, but not limited to, a Therabody Authorized Reseller, agent, or Authorized Distributor to make any modification, extension, or addition to this Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

THERABODY DOES NOT WARRANT THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERABODY IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING ANY PROGRAM OR DATA STORED IN OR USED WITH THE THERABODY PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED IN THE PRODUCT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE THERABODY’S LIABILITY SHALL NOT BE GREATER THAN PURCHASE VALUE OF THE PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This Warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

In no event shall this Warranty require more than the replacement of any part or parts which is found to be defective within the effective warranty period. No refunds will be given. If replacement parts for defective products are not available, Therabody reserves the right to make product substitutions in lieu of replacement. This Warranty does not apply to any mobile device or the cellular and/or other network or system on which the product operates. Therefore, Therabody will not accept any responsibility under this Warranty for the operation, availability, coverage, services or range of the cellular or other network or system. Therabody shall not under any circumstance be liable either expressly or impliedly, for any damages or losses of any kind whatsoever resulting from loss of, damage to, or corruption of, content or data during replacement of the product.

Therabody Certified Refurbished Product

Therabody warrants that Certified Refurbished products sold by Therabody will be free from defects in material and workmanship when used normally in accordance with Therabody’s published guidelines for a period of 1-Year from the delivery date of the product to the end-user purchaser. Please note that Certified Refurbished products may show minor signs of use that affect cosmetic appearance, may not come in their original packaging, and non-essential parts or accessories may be missing (as identified on each individual product).
